Terms of Service

These Terms of Service govern your access to and use of ProofFlight's website, applications, and services. By creating an account, booking a survey, or otherwise using ProofFlight, you agree to these terms. If you do not agree, do not use the service.

ProofFlight is a marketplace that connects property owners with independent, FAA Part 107 certified drone pilots who capture timestamped, geo-tagged aerial documentation of a property. We provide the booking, scheduling, payment, and secure storage (the ProofFlight Vault) that support these surveys.

ProofFlight is a documentation service only. We are not an insurance company, insurance producer, public adjuster, contractor, engineer, or law firm. We do not inspect for code compliance, appraise property, adjust or negotiate claims, or provide insurance or legal advice. Any information on our website about insurance claims is general and for education only.

We do not guarantee that documentation captured through ProofFlight will be accepted by any insurer, that a claim will be approved, or that any particular payout, timeline, or result will occur. Coverage decisions are made solely by your insurer under your policy. Illustrative figures, scenarios, and examples on our website are for explanation only and do not represent a promise of results.

• You must be at least 18 years old to use ProofFlight.
• You are responsible for the accuracy of the information you provide, including the property address and access details.
• You are responsible for keeping your login credentials confidential and for activity under your account.
• You represent that you own the property to be surveyed or are authorized to request its documentation.

• Price: a standard survey is $299. A $50 deposit is charged at booking to confirm your appointment, and the $249 balance is charged before captured footage is released in your Vault.
• Processing: payments are handled by Stripe. By booking, you authorize the applicable charges.
• Pilot payouts: pilots are paid their agreed share via Stripe Connect after the balance is collected.
• Taxes: prices exclude any applicable taxes, which may be added at checkout.

Surveys depend on weather, airspace, and site conditions and may need to be rescheduled for safety or legal reasons. If a survey cannot be completed for reasons outside your control, we will work with you to reschedule or refund the deposit. Once footage has been captured and delivered, the survey is considered rendered. To request a change or cancellation, contact us as early as possible.

Pilots who accept work through ProofFlight are independent contractors, not our employees or agents. Pilots are responsible for operating lawfully, including compliance with FAA Part 107 and all applicable airspace and privacy rules, and for maintaining their own equipment and insurance.

• Do not request surveys of property you do not own or are not authorized to document.
• Do not use the service to violate any law, infringe others' rights, or invade privacy.
• Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the service.
• Do not misrepresent documentation or alter footage in a misleading way.

As between you and ProofFlight, the survey footage and reports captured for your property are provided for your use, including sharing with your insurer or adjuster. You grant ProofFlight a limited license to store, process, and deliver that content to operate the service. You retain access to your Vault content in accordance with these terms and our Privacy Policy.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that documentation will satisfy any specific insurer requirement.

To the maximum extent permitted by law, ProofFlight and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or denied or underpaid insurance claims. Our total liability for any claim relating to the service will not exceed the amount you paid to ProofFlight for the survey giving rise to the claim.

You agree to indemnify and hold ProofFlight harmless from claims, damages, and expenses arising out of your misuse of the service, your violation of these terms, or your violation of any law or the rights of a third party.

We may modify or discontinue features, and we may update these terms from time to time. Material changes will be reflected in the date above. Your continued use of the service after changes take effect constitutes acceptance.

These terms are governed by the laws of the United States and the state in which ProofFlight is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.
